| Abstract: | Bakalářská práce se zabývá právními a etickými otázkami okolo používání dat a výstupů umělé inteligence. Práce identifikuje hlavní rizika, která tyto praktiky přinášejí, a zaměřuje se na to, jak evropské právo na ně reaguje. Zkoumá také, jestli a jak moc právní řešení odpovídají etickým požadavkům kladeným na odpovědný vývoj umělé inteligence. Právní a etická východiska jsou následně aplikována na případové studie LAION a Clearview AI, které představují dva odlišné způsoby využívání dat v umělé inteligenci. Analýza ukazuje, že u některých datových praktik mezi právním a etickým hodnocením vzniká výraznější napětí, zatímco v jiných případech jsou závěry právní analýzy více podobné závěrům etickým. Výstupem práce je soubor zásad pro eticky a právně odpovědné nakládání s daty v umělé inteligenci. Tato pravidla vznikla na základě problémů identifikovaných v analyzovaných případech. |

| Abstract: | This bachelor’s thesis examines the legal and ethical issues associated with the use of data and AI outputs. It identifies the main risks associated with these practices and focuses on how European law addresses them. It also explores whether and to what extent legal solutions align with the ethical requirements for the responsible development of artificial intelligence. The legal and ethical foundations are then applied to the case studies of LAION and Clearview AI, which represent two different ways of data usage in artificial intelligence. The analysis shows that in some data practices, the tension between legal and ethical assessments is more pronounced, while in other cases, the legal conclusions are more similar to the ethical ones. The outcome of the thesis is a set of principles for ethically and legally responsible handling of data in artificial intelligence. These principles are derived from problems identified in the analysed cases. |
