Obsahem práce je analýza historického vývoje a současného vnímání daňových rájů v kontextu mezinárodního zdanění a obranných mechanismů států proti vyhýbání se daňovým povinnostem. Práce zkoumá dopady pravidel pro ovládané zahraniční společnosti na přeshraniční investování a detailně porovnává vybrané benevolentní jurisdikce. Stěžejní částí je případová studie modelující využití kyperské obchodní společnosti pro aktivní obchodování českým daňovým rezidentem. Práce definuje nezbytné požadavky na vybudování prokazatelné ekonomické podstaty a kalkuluje s nimi spojené fixní náklady. Pomocí matematického modelu a aplikace finanční páky je následně stanoven bod zlomu. Čtenář tak získá exaktní přehled o tom, od jaké výše počátečního kapitálu se mezinárodní daňová optimalizace založená na efektu daňového odkladu investorovi reálně vyplatí.
The content of this work is an analysis of the historical development and current perception of tax havens in the context of international taxation and state defence mechanisms against tax evasion. The work examines the impact of Controlled Foreign Company rules on cross-border investing and compares selected benevolent jurisdictions in detail. The core part is a case study modelling the use of a Cyprus commercial company for active trading by a Czech tax resident. The work defines the necessary requirements for building a demonstrable economic substance and calculates the associated fixed costs. Using a mathematical model and the application of financial leverage, the break-even point is subsequently determined. The reader thus gains an exact overview of the initial capital threshold at which international tax avoidance based on the tax deferral effect becomes practically profitable for the investor.
