The theoretical part describes the history of economic analysis of law, the theory of rational choice, Gary S. Becker's model of criminal behaviour and the subsequent development of the economics of crime after Becker's study and studies dealing with prisons and alternative punishments, especially within the European Union. The practical part applies the findings from the theoretical part into practice by using partial analyses of the countries under study: the Czech Republic, the Slovak Republic, Poland, Hungary, Austria and the Federal Republic of Germany, which are then subjected to a detailed comparison. The main focus is the analysis of phenomena related to the prison system, such as: the development of prison populations, daily costs per prisoner, the costliness of prison systems and the possible use of electronic monitoring as an alternative to imprisonment. The thesis concludes by analysing the comparison of the cost of imprisonment and electronic monitoring and confirms the hypothesis that alternative sentences reduce the cost of punishing crime. |
