| Abstract: | Práce definuje a analyzuje stávající pravidla fungování a legislativní úpravu ochrany hospodářské soutěže v principu de lege lata v ČR s ohledem na působení národních šampiónů a okrajově z pohledu politiky národních šampiónů v Evropě, analyzuje v daném principu postavení národních šampiónů a zařazuje stávající podmínky do kontextu s globálními vlivy v dané oblasti, přináší argumenty týkající se existence a postavení národních šampiónů v prostředí ochrany hospodářské soutěže (de lege lata kontra de lege ferenda) z hlediska různých aspektů jejich působnosti. S ohledem na stanovený cíl práce byla řešena problematika právní úpravy neoprávněných odběrů elektrické energie v kontextu případného zvýhodnění národního šampióna a vzniku případné újmy jiných soutěžitelů či spotřebitelů v důsledku tohoto zvýhodnění. Cílem této práce je popsat právní úpravu de lege lata v České republice týkající se neoprávněných odběrů elektrické energie a jejich prokazování a řešení a zodpovědět otázku, zda úprava de lege ferenda může odstranit případnou újmu jiných soutěžitelů či spotřebitelů. |

| Abstract: | This thesis defines and analyzes the existing rules of procedure and legislation to protect competition in the principle of de lege lata in the Czech Republic with regard to the operation of national champions and marginally in terms of policy, national champions in Europe, analyze the status of the principle of national champions and classified in the context of existing conditions with global effects in the field, arguments concerning the existence and status of national champions in the competition (de lege lata versus de lege ferenda) in terms of various aspects of their responsibilities. With regard to the objective of work was dealing with the issue of regulation of irregular acquisition of electric power in the context of the possible advantage of champion and the emergence of any injury to other competitors or consumers as a result of this advantage. The aim of this work is to describe the regulation of de lege lata in the Czech Republic on irregular acquisition of electric power and showing a solution and to answer the question of whether the change de lege ferenda may remove any harm other competitors or consumers. |
