| Abstract: | Diplomová práce se zabývá přístupem, úrovní, významem, smyslem a přínosem ochrany osobních údajů, při jejich zpracovávání v rámci policejní a justiční spolupráce v EU. Na úvod je vymezena základní problematika ochrany osobních údajů v EU a v ČR, se zaměřením na vysvětlení terminologie a aktuální problematiku, zejména oblast biometrických údajů a data retention. Zvláštní pozornost je navíc věnována kolizi práva na ochranu soukromí, a s ním souvisejícího práva na ochranu osobních údajů, a zájmu na ochraně veřejného pořádku a bezpečnosti. Dále se práce zabývá konkrétním prováděním policejní a justiční spolupráce v EU, a to prostřednictvím zvláštních subjektů, zejména Eurojustu a Europolu. Závěrečná část diplomové práce se zaměřuje jednak na konkrétní provádění ochrany osobních údajů při policejní a justiční spolupráci v EU, a jednak na význam ochrany osobních údajů při policejní a soudní spolupráci, jakožto odvozeného základního lidského práva, a úskalí, která jsou s ochranou osobních údajů při policejní a justiční spolupráci v EU spojena. Součástí závěrečné části práce je také nástin hlavních oblastí, ve kterých je možné hledat prostor pro úpravy směřující k zefektivnění policejní a justiční spolupráce v EU za současného plného respektování práva na ochranu osobních údajů. |

| Abstract: | The thesis deals with the approach level, meaning, purpose and benefit of personal data protection in their processing within police and judicial cooperation in the EU. In the introduction the fundamental issues of personal data protection in the context of the EU and the Czech republic are defined, focusing on terminology and explanations of current issues, particularly the area of biometric data and data retention. Extra attention is also given to the conflict of the right to privacy, and the related right to personal data protection and protection of public interests and safety. After that the thesis deals with a performing of police and judicial cooperation in the EU through specific subjects, in particular Europol and Eurojust. The final part of the thesis focuses on the practical implementation of personal data protection in police and judicial cooperation in the EU, and secondly the importance of personal data protection in police and judicial cooperation, as a deduced basic human right, and the difficulties with which the personal data protection in police and judicial cooperation in the EU are joined. The final part of this thesis consider the main sections in which we can find area for adjustment towards more effective police and judicial cooperation in the EU, with full respect for the right to personal data protection. |
