| Abstract: | Oběžná dráha Země, jakožto prostor pro umístění telekomunikačních satelitů a jiných objektů, má pro hospodářský rozvoj společnosti rostoucí význam. Závažný problém ovšem představuje znečištění tzv. vesmírným odpadem z lidské činnosti. Cílem práce je poskytnout komplexní pohled na znečištění zemské orbity ve vztahu k instituci vlastnictví. Nejprve se zaměřuje na současné mezinárodně-právní uspořádání v této oblasti, jeho vývoj a důsledky. Následuje ekonomická analýza nejzávažnějšího z těchto důsledků -- znečištění, přičemž je posuzován argument, že znečištění oběžné dráhy je logickým důsledkem nedostatečně vymezených vlastnických práv. Práce se dále zabývá problematikou vymezení vlastnických práv se zřetelem na to, zda je tento institut v této podobě realizovatelný či ekonomicky efektivní. Závěr práce představuje diskusi nad alternativami v řešení problému znečištění zemské orbity. |

| Abstract: | Earth's orbit as a space for placement of telecommunication satellites and other objects is growing in importance for the economic development of mankind. Serious problem, however, is the so-called space debris pollution from human activities. The aim of this work is to provide a comprehensive view of the Earth's orbit contamination in relation to the institution of property rights. First, the discussion focuses on current international legal arrangements in this area, its development and implications. This is followed by an economic analysis of a space pollution, the argument is considered that pollution of the orbit is a logical consequence of incompletely specified property rights. The thesis also deals with the establishment of property rights with respect to whether the institute is viable and economically efficient. The conclusion of the work presents a discussion of alternatives in solving the problem of manmade space pollution. |
