| Abstract: | Cílem práce je seznámit čtenáře s problematikou autorského práva v oblasti hudby a vysvětlit principy, na kterých funguje Ochranný svaz autorský (OSA). Práce se věnuje popisu činnosti OSA a problematickým oblastem v praktickém výkonu správy autorských práv k hudebním dílům. V teoretické části práce jsou vysvětleny základní pojmy související s činností OSA, objasněny kompetence řídících orgánů, popsány základní principy kolektivní správy práv, popsán systém výběru a rozúčtování autorských odměn a je zde rovněž vysvětlena vazba OSA na státní rozpočet České republiky. V praktické části práce je proveden výzkum mínění odborné veřejnosti o problematice OSA a jsou zde popsána praktická témata správy autorských práv. Závěrečná část pak nabízí OSA a aktérům správy autorských práv řešení některých nedostatků. |

| Abstract: | The aim of the paper is to make the reader acquainted with questions of music copyright and to explain the principles on which Society for the Protection of the Rights of Music Authors and Publishers (OSA) operates. The paper is focused on a description of OSA's activities and problematic spheres in applied execution of collective administration of authors' rights to musical works. In a theoretical section of the paper there are explained basic terms related to OSA's activities, clarified competences of management, described basic principles of collective administration of rights, there is described a schema of collecting and paying royalty fees, and an attachment of OSA to the state budget of the Czech Republic as well. In a practical section of the paper there is a research on opinion of vocational public about the questions of OSA and there are described practical subjects of administration of authors' rights. The final section then offers OSA and participants of administrations of authors' rights solutions to some failures. |
