| Abstract: | Bakalářská práce se věnuje tématu ukončování pracovních poměrů zaměstnavatelem. V prvních kapitolách definuje ochrannou funkci pracovního práva a její projevy v součastnosti. Práce se zaobírá taktéž tématem povinností zaměstnanců a prameny těchto povinností. Hlavní část pokrývá problematiku obsahových a formálních náležitostí rozvazujících právních úkonů zaměstnavatele. Speciální kapitola řeší otázky spojené z výpovědními důvody a důvody k okamžitému zrušení pracovního poměru. Všechny předpoklady jsou testovány na judikatuře českých soudů. Dále práce reaguje na velkou novelizaci zákoníku práce, účinnou k 1.1.2012. V závěrů přichází ke slovu právní úprava de lege ferenda a návrh na změnu zákoníku práce. |

| Abstract: | The bachelor thesis is dedicated to the termination of an employment contract. At the beginning the thesis focuses on the protecting role of labour law and the duties of employees. Then the thesis tries to deal with the legally supported ways how to terminate the relation between employer and employee (notice of cancellation, notice of immediate cancellation and cancellation during probation). Furthermore, the thesis processes the essential formal proprieties of employer's legal operations that lead to the termination of an employment contract. The thesis also reacts on the amendment to Labour Code in force from 1st January 2012. The assumptions are tested by court decisions. At the end the thesis contains the assessment of an amendment to Czech Labour Code. |
