| Abstract: | Cílem práce je postihnout historický vývoj ochrany práv a zastupování autorů. V rámci vývoje autorského zákona se vystřídalo od osamostatnění naší země od Rakouska-Uherska celkem pět předpisů. V práci je zdůvodněna potřebnost ochrany uměleckých děl a uměleckých výkonů, jež je odvozena od základního práva vlastnictví nehmotných statků. Dále se práce věnuje právnímu vydefinování kolektivní správy ochranných organizací ve stávající právní úpravě. Největší pozornost je zaměřena ke kolektivnímu správci autorských práv na poli hudebního průmyslu, a to k Ochrannému svazu autorskému o. s. Cílem práce je zhodnotit fungování kolektivní správy v praxi. Na datech poskytnutých jedním autorem z hudebního tělesa malého rozsahu je ozřejměno konkrétní rozúčtování. Přínosem práce je komplexní zhodnocení OSA jako instituce poskytující kolektivní správu práv a celkovou péči autorům a identifikace hranice, od kdy je zastupování tímto kolektivním správcem pro autora smysluplné. |

| Abstract: | The aim of the thesis is to describe historical development of copyright protection and representation of authors. The Czech copyright has changed five times since the Czech Republic gained independence from Austro-Hungarian Empire. There is justified the importance of copyright protection of artistic works and artistic performances. The copyright protection and artistic performances originate from basic ownership law of intangible goods. The thesis describes the definition of collective rights management societies. It is focused primarily on The Copyright Protection Association for Music Rights in the Czech Republic. The thesis evaluates the functioning of Copyright Protection Associations in practice. There is described a distribution of royalties based on data gained from an author of a band of a small scale. The contribution of the thesis is a complex evaluation of OSA as an institution which is providing collective copyrights protection and all kinds of services for authors. The contribution is to identify where exists the limit from which it is reasonable for an author to be represented by the collective rights management society. |
