| Abstract: | Patentová ochrana inovací je aktuálně skloňována v souvislosti s jedním z největších patentových sporů v historii firem Apple a Samsung. O obhajobu samotné existence instituce ochrany duševního vlastnictví se ekonomové přou a mezi ekonomickými školami neexistuje konsenzus. Současný systém funguje plošně napříč všemi odvětvími ekonomiky. Cílem práce je potvrdit či vyvrátit hypotézu implicitně podporující rozdílné nastavení patentového systému vzhledem k rozdílnému charakteru odvětví. Průmysl informačních technologií, kde je hypoteticky efektivita nízká (patentování je zde tradičně využíváno ke strategickým účelům), je konfrontován s chemickým průmyslem, ve kterém by patentování mělo přispívat k růstu více (tradice ochrany účinné látky). Práce shrnuje argumenty napříč spektrem ekonomických škol. Regresní analýza dat zemí EU podporuje zkoumanou hypotézu a poukazuje na nízký vliv IT patentů na HDP oproti chemickému průmyslu ve zkoumaném vzorku zemí EU. |

| Abstract: | Currently, legislative patent protection is one of "the hottest topics" due to a billion-dollar lawsuit between Samsung and Apple. There is an academic discourse related to the importance of the patent protection regulations. Contemporary legal system impacts all fields of economics. A purpose of this study is to test hypothesis (that): "there should be an inhomogeneous patent-protection setting for particular industries". The IT industry, recognized for its low efficiency of regulation, is to be compared with the chemical industry, which, on contrary, is suggested to be stimulated by rigid regulation. This thesis brought a critical academic discussion leading to a quantitative regression analysis, which then supported the working hypothesis. |
