| Abstract: | Diplomová práce se dle zákona č. 182/2006 Sb., o úpadku a způsobech jeho řešení (insolvenčního zákona) zabývá řešením úpadku reorganizací. Za pomoci komparační metody analyzuje dvě konkrétní insolvenční řízení, které proběhly v minulosti a na základě vzájemného srovnání určí významné faktory, na jejichž bázi bylo dosaženo rozdílných výsledků řízení. Hlavním cílem práce je tedy identifikace faktorů ovlivňujících výsledek řízení a to jak pozitivně, tak negativně. V první teoretické části dochází k rozboru vybraných částí insolvenčního zákona. Výsledky a znalosti získané v první části jsou dále aplikovány na analýzu a srovnání konkrétních dvou firem, přičemž byly využity také hodnoty získané z finančních výkazů firem i data pro výpočet indexu IN05. Tyto hodnoty společně s modelem IN05 jsou aplikovány v reflexi jednotlivých reálií a významných momentů, které měly zásadní vliv na výsledek procesu reorganizace. V závěru jsou sumarizovány všechny získané poznatky a provedeno rozkrytí jednotlivých faktorů úspěšnosti a neúspěšnosti daných reorganizačních řízení, kde se ukazuje, že výsledek reorganizace je pro externího diváka obtížně předvídatelný. |

| Abstract: | The Master's Thesis is focused on reorganization as bankruptcy solution according to Act No. 182/2006 Coll., Bankruptcy and Settlement (Insolvency Act), as amended. With a usage of comparison method, it analyses two specific insolvency proceedings which were solved in past and on the basis of their mutual comparison identify important factors that were crucial to determine different results of the proceedings. The main goal of the thesis is to uncover the factors affecting the insolvency proceeding positively or negatively. In first theoretical part there is the analysis of Insolvency Act. The results and knowledge gained in the first part are applied to a comparison in the second one where various data from financial reports and index IN05 are used. These values together with IN05 model are applied as a reflection of important moments which had underlying influence on reorganization process result. In the end of the thesis there is the summary of all gained facts and also different important negative and positive factors are revealed. The thesis shows that it is very difficult to anticipate the result of reorganization for external subject. |
