| Abstract: | Práce se zabývá povahou závodu v nové právní úpravě po rekodifikaci občanského práva a rovněž i historickým vnímáním daného pojmu. Zabývá se právními instituty spojenými se závodem a pokouší se určit jednotlivé složky závodu. Práce obsahuje právní úpravu dispozice s obchodním zákonem i, co se týče smluvních typů zákonem výslovně neupravených, a dále pak srovnání s předchozí úpravou a francouzskou právní úpravou. Metodami výzkumu jsou převážně jednotlivé typy právního výkladu, a to včetně těch nestandardních. V souvislosti s jednotlivými instituty je zmíněna i judikatura, která se k nim vztahuje. Tam, kde se autor domnívá, že je úprava vadná anebo nedostatečná, práce obsahuje i doporučení pro odlišnou právní úpravu. |

| Abstract: | The thesis concerns with nature of undertaking after recodification of civil law as well as with historical perception of present notion. It treats on the legal institutes related with undertaking and attempts to define the components of an undertaking. It contains legislations of disposi-tions with an undertaking, as well as the types not predicted by law, and furthermore compari-son with previous and French legislation. The methods used in the thesis are primarily based on the types of legal interpretations including the non-standard ones. The relevant judicature concerning the subject is mentioned too. Thesis contains also recommendations of legal changes where author finds the legislation defective or insufficient. |
