| Abstract: | Tato práce se zabývá procesem reorganizace a přibližuje jej jako způsob řešení úpadku vhodný pro podnikatele. Na úvod práce je vymezen úpadek spolu s alternativami jeho řešení. Dále je pak přiblížena reorganizace ve své standardní podobě, od její definice a přípustnosti, přes procesní stránku podání návrhu na povolení reorganizace až po její schválení insolvenčním soudem. Přiblížen je také reorganizační plán. Poslední kapitola se věnuje předpřipraveným reorganizacím s důrazem na její hlavní výhody a nevýhody a zaměření se na otázku jejího významu v současném právním systému. Součástí práce je i přehled vývoje počtu povolených reorganizací v uplynulých letech. |

| Abstract: | The thesis deals with a process of reorganization describing it as an insolvency resolution method convenient for an entrepreneur. Firstly, a definition of a bankruptcy is presented together with the possible alternatives of how to resolve it. The next chapter deals mainly with reorganization per se - starting with its definition and admissibility. Then there is presented the process part from the very beginning of reorganization petition up to its approval by a court. This thesis also deals with the plan of reorganization. The last chapter focuses on the prepackaged reorganizations emphasizing its advantages and disadvantages. This chapter concentrates on the meaning and on the importance of prepackaged reorganizations in the current Czech law system. Last but not the least, the thesis also incorporates a statistical overview of successfully approved reorganizations over the course of last couple of years. |
