| Abstract: | Tato diplomová práce se zabývá problematikou oddlužení jako způsobu řešení úpadku a jejím cílem je poskytnout čtenáři ucelený přehled o současné právní úpravě oddlužení. První kapitola je věnována právní úpravě insolvenčního práva a vymezení základních pojmů. Druhá kapitola je zaměřena na samotné insolvenční řízení a jeho zásadám. Ve třetí kapitole je vymezen pojem úpadek a způsoby jeho řešení. Hlavní část práce je věnována konkrétním fázím oddlužení a způsobům jeho řešení, tedy zpeněžení majetkové podstaty a splátkovému kalendáři. V poslední kapitole je zmíněna novela insolvenčního zákona, která s sebou přinesla důležité změny v oblasti oddlužení. |

| Abstract: | This diploma thesis deals with the issue of debt relief as a method of solving bankruptcy and its aim is to provide readers with a comprehensive overview of the current legal regulation of debts. The first chapter deals with legal regulation of insolvency law and definition of basic concepts. The second chapter focuses on insolvency proceedings themselves and its principles. The third chapter defines the concept of bankruptcy and the ways of its solution. The main part of the thesis is devoted to the specific phases of debt relief and the ways of its solution, namely the asset monetization and payment schedule. The last chapter deals with the amendment to the Insolvency Act, which brought important changes into the area of debt relief. |
