Abstract: | Manipulace odhadované hodnoty veřejných zakázek za účelem méně transparentního zadávacího řízení byla prokázána v několika evropských zemích, ovšem důvody této manipulace nebyly zatím dostatečně popsány. Práce analyzuje veřejné zakázky v České republice s odhadovanou hodnotou v okolí limitu pro zjednodušené podlimitní řízení, které lze považovat za nejméně transparentní. Analýza na datech za roky 2013 až 2016 pomocí odhadu hypotetické distribuce odhadované hodnoty ukazuje, že objem manipulovaných veřejných zakázek pod tuto hranici relativně k průměrnému odhadovanému počtu v případě absence legislativního omezení činí 891 – 972 %. Výsledky porovnání charakteristik dodavatelů pod a nad limitem pro zjednodušené podlimitní řízení indikují, že zatímco v případě zkušených zadavatelů dochází k manipulaci častěji za účelem s celkovým pozitivním dopadem, u méně zkušených zadavatelů častěji za účelem s celkovým negativním dopadem. Výsledky naznačují, že méně zkušení zadavatelé se častěji dopouštějí korupčního jednání. |

Abstract: | Manipulation of anticipated public procurement value for a less transparent procurement procedure has been demonstrated in several European countries, but the reasons for this manipulation have not been sufficiently described. The thesis analyzes public procurement contracts in the Czech Republic with an anticipated value near the limit for simplified negotiating procedure, which is the least transparent. Analyzing the data for the years 2013 to 2016 by estimating the contrafactual distribution of anticipated value shows that the volume of manipulated public procurement contracts below the threshold relative to the average estimated number of public procurement contracts with the absence of a legislative limitation is 891-972%. The results of a comparison of suppliers’ characteristics below and above the threshold for simplified negotiating procedure indicate that experienced contracting authority manipulate anticipated value for purpose with overall positive impact and less experienced contracting authority manipulate anticipated value for purpose with overall negative impact. The results indicate that less experienced contracting authority is more likely to commit corrupt practices. |
