| Abstract: | Cílem této diplomové práce je popsat ústavní vývoj Československa a z něj vycházející jednotlivé ústavy obou republik jako již samostatných států. Téma je vybráno s přihlédnutím k faktu, že ústava je právním předpisem s nejvyšší silou každého demokratického státu, a proto ovlivňuje život všech občanů dané země. Je zde popsán ústavní federativní vývoj a jeho krize v letech 1989 – 1992, která vyústila v přijetí Ústavy ČR a Ústavy SR a ve vznik dvou nových samostatných států. Díky ústavní komparatistice je dokázáno, že ústavy obou republik mají konvergentní charakter i přes to, že vycházejí z rozdílných zdrojů. Ústava SR přece jen lépe uspokojuje potřeby občanů státu a je lépe koncipována. |

| Abstract: | The aim of this diploma thesis is to describe the constitutional development of Czechoslovakia and the individual constitutions of both republics as independent states. The theme has been chosen with regard to the fact that the constitution is legal regulation with the highest power of any democratic state and therefore influences the life of all citizens of the given country. The topic describes the constitutional federal development and its crisis between 1989 and 1992, which resulted in the adoption of the Constitution of the Czech republic and Constitution of the Slovak republic and the creation of two new independent states. Constitutional comparisons prove that the constitutions of both republics have convergent character despite the fact that they are based on different sources. The Constitution of the Slovak republic still better meets the needs of the citizens of the state and is better conceived. |
