| Abstract: | Tato diplomová práce se zabývá doménovými jmény a jejich právními aspekty s bližším zaměřením na doménové spory. První kapitola obecně vymezuje doménová jména, mezinárodní organizace působící v oblasti doménových jmen a postavení doménových jmen z pohledu právního řádu České republiky. První kapitola také představuje jednotlivé typy doménových jmen a nejčastější praktiky zneužívání doménových jmen. Druhá kapitola se zaměřuje na doménové spory a možnosti jejich řešení, porovnání alternativního řešení doménových sporů oproti řízení před obecnými soudy, jakož i porovnání alternativního řešení sporů před Rozhodčím soudem s alternativním řešením sporů podle pravidel UDRP a ADR.eu. Třetí kapitola se věnuje doménovým jménům v kontextu v nekalé soutěži a roli ochranné známky v doménových sporech. |

| Abstract: | This diploma thesis deals with domain names and their legal aspects with focus on domain name disputes. The first chapter generally defines domain names, international organizations active in the field of domain names and the role of domain names from the perspective of Czech legal order. The first chapter also introduces types of domain names as well as the most common types of misuse of domain names. The second chapter is dedicated to domain name disputes and its possible solutions, comparison of alternative dispute resolution with proceeding before Czech ordinary courts as well as comparison of ADR before Czech Arbitration Court with alternative dispute resolution according to UDRP and ADR.eu. The third chapter focuses on domain names in context of unfair competition and the role of trademarks in domain name disputes. |
