| Abstract: | Bakalářská práce se zaměřuje na problematiku zásady předběžné opatrnosti a její aplikaci v rámci sporných řízení na poli Světové obchodní organizace. Cílem práce je objasnit nejen význam předmětné zásady, ale i vliv globalizace na vývoj mezinárodního obchodování. Text je členěn do pěti kapitol, z nichž první tři tvoří část teoretickou. V té dochází k objasnění vzniku, klíčových znaků a významu zásady předběžné opatrnosti. Dále jsou zkoumány současné trendy a stav environmentální politiky včetně pramenů práva spojených se životním prostředím a Světovou obchodní organizací. Praktická část se zabývá systémem řešení sporů WTO, institucionálním rámcem a základními principy, jež s procesem řešení sporů souvisí. V rámci závěrečné analýzy dvou vybraných případů dochází ke zhodnocení praktického využití předběžné opatrnosti v rozhodovací praxi sporných řízení. |

| Abstract: | This bachelor thesis focuses on the issue of the precautionary principle and its use in the context of dispute settlement system of the World Trade Organization. The aim of the thesis is to clarify not only the importance of the subject principle but also the influence of globalization on the development of international trade. the text is divided into five chapters, the first three of which are theoretical. This part explains the origin, key features and the importance of the precautionary principle. Moreover, the current trends and the state of environmental policy, including sources of environmental and the World trade Organization law, are examined. The practical part of this thesis deals with the WTO dispute settlement system as such, the institutional framework and the fundamental principles that are related to the dispute resolution procedure. Lastly, the practical application of the precautionary principle within the WTO disputes is evaluated based on an analysis of two case studies. |
