| Abstract: | Bakalářská práce s názvem Komparace právní úpravy mediace v ČR, v Německu a v Rakousku má za cíl komparovat právní úpravu mediace v České republice, v Německu a v Rakousku. Práce se skládá z pěti kapitol. V první kapitole je věnováno několik slov obecným informacím o mediaci a mediátorovi. Následně navazují kapitoly, které se týkají již samotné právní úpravy mediace. V druhé kapitole z pohledu Evropské unie a v následujících již v každém z vybraných států odděleně. V závěrečné kapitole jsou právní úpravy ve vybraných státech komparovány. Cílem práce je pomocí stanovených výzkumných metod ověřit stanovené hypotézy, že mediace je ve všech těchto vybraných státech právně upravena, v Německu a Rakousku je mediace více známá a více využívána než v České republice a že právní úprava vede ke zvýšení využívání mediace. |

| Abstract: | The bachelor thesis named Comparison of legal regulation of mediation in the Czech Republic, Germany and Austria focuses on comparison legislation of mediation in the Czech Republic, Germany and Austria. The thesis consists of five chapters. The first chapter defines mediation as an alternative methods of dispute resolution and mediator. Subsequent chapters describes legislation. In the second chapter from the perspective of European Union and in the following chapters from the perspective of selected states. In the final chapter these systems are compared. The aim of the this thesis is to verify the established hypothesis by research methods. The hypothesis are that mediation is legally regulated in all of these selected countries and that mediation in Germany and Austria is more known and used than in the Czech Republic and that legal regulation leads to increase use of mediation. |
