| Abstract: | Diplomová práce se zabývá zhodnocením stavu právní ochrany databází na základě rešerše a následné analýzy 40 právních předpisů a 19 judikaturních dokumentů dopadající na oblast informačních technologií, a to jak z pohledu českého právního řádu, tak z pohledu práva unijního. Právní ochrana databáze je dokumentována z pohledu softwaru, který ji řídí, z pohledu vlastní databáze a její struktury, a také z pohledu v ní vedených dat. Práce dále hodnotí interpretační vývoj pojmů právní ochrany databází z pohledu Evropského soudního dvora resp. Soudního dvora Evropské unie od roku 2004 do současnosti. Ve své druhé části práce identifikuje specifickou legislativu a pravidla dopadající na informační systémy ve veřejné správě a v prostředí českého eGovernmentu. V závěru je práce doplněna o názorné ukázky aplikovatelnosti právní ochrany na modelové příklady databází a o popis reálného příkladu ochrany údajů databáze. |

| Abstract: | The diploma thesis deals with evaluation of the state of legal protection of databases based on the research and the subsequent analysis of 40 legal regulations and 19 jurisprudential documents affecting the field of information technologies, both from the point of view of the Czech legal order and from the point of view of EU law. The legal protection of the database is documented from the point of view of the software that governs it, from the point of view of its own database and its structure, as well as from the viewpoint of the data. The thesis further evaluates the interpretation of the concepts of legal protection of databases from the point of view of the European Court of Justice, Court of Justice of the European Union from 2004 to the present. In the second part of the thesis it identifies the specific legislation and rules affecting the information systems in the public administration and in environment of the Czech eGovernment. In conclusion, the thesis is supplemented with illustrative examples of the applicability of legal protection to model examples of databases and a description of a real example of data protection of the database. |
