| Abstract: | Diplomová práce se zabývá problematikou smluv v projektovém řízení v IT. Cílem práce je analyzovat současnou úpravu smluv, které jsou v projektovém řízení používány, a vyhodnotit, zda je současná česká právní úprava smluv dostačující, případně navrhnout vhodnější řešení. Autorka si stanovila hypotézu, že současná právní úprava je nedostatečná. V práci je použita metoda analýzy, deskripce a komparace. V práci je také srovnáno několik projektových metodik, včetně jedné agilní. Autorčina hypotéza se potvrdila v případě agilních projektů. Český zákonodárce zatím nedokáže na tyto flexibilní projektové postupy reagovat, a proto autorka navrhla vlastní smluvní úpravu takto vedených projektů. |

| Abstract: | The diploma thesis deals with issues of contracts in project management in IT. The aim of the thesis is to analyze the current Czech legislation of the contracts that are used in the project management and to evaluate whether the current Czech legislation is sufficient. The author has established the hypothesis that current legislation is inadequate. The method of analysis, description and comparison is used in the thesis. Several project methodologies, including one agile, are also benchmarked. The author's hypothesis was confirmed in agile projects. The Czech legislature has not yet been able to respond to these flexible project procedures, so the author has proposed a contractual solution to solve such projects. |
