| Abstract: | Bakalářská práce se zabývá porovnáním způsobu řešení úpadků právnických osob. Cílem práce je popsat a porovnat rozdíly mezi konkursem a reorganizací. K porovnání ukazatelů počtu řízení, průměrné doby trvání řízení a průměrné míry uspokojení pohledávek věřitelů je prováděn kvantitativní výzkum. Rozdíly mezi konkursem a reorganizací jsou zjišťovány pomocí SWOT analýzy obou procesů a analýzou postavení dlužníka, zajištěného a nezajištěného věřitele. Součástí práce je analýza způsobu řešení úpadku právnických osob ve Spojeném království Velké Británie a Severního Irska a srovnání celkového přístupu řešení úpadku v Čechách. Práce obsahuje úvahy de lege ferenda, které by vedly ke zvýšení účinnosti obou typů řízení. |

| Abstract: | The thesis looks into insolvency of legal entities and compares ways of resolution. The aim of thesis is to describe and compare differences between compulsory liquidation and reorganization. Quantitative research has been used to compare indicators such as: quantity of certain type of proceedings, average length of the proceedings, average recovery rate of claims. To find out differences between compulsory liquidation and reorganization I used SWOT analysis of both processes and analyzed position of debtor, unsecured and secured creditor. Thesis contains analysis of insolvency procedures concerning legal entities in The United Kingdom of Great Britain and Northern Ireland. It also compares general approach how to deal with insolvency for both countries. Thesis contains thoughts de lege ferenda in particular that would lead to higher efficiency of both processes. |
