| Abstract: | Tato práce má za cíl čtenáře seznámit s konceptem zásady předběžné opatrnosti v pojetí práva Evropské Unie, konkrétně pak s jeho interpretací v rámci SDEU. Tento princip představí jak v rámci teoretické definice, legislativního ukotvení tak i v praktickém užití v judikatuře Soudního dvora EU. Nejdříve práce analyzuje pojem jako takový – vznik a první implementace do mezinárodních smluv a běžné praxe. Dále se zabývá jeho ukotvením v legislativě Evropské Unie. Nakonec rozebírá samotnou praxi – na vybraných typech řízení před SDEU poukazuje na praktické užití, respektive neužití, tohoto principu u konkrétních případů v tematicky různých problematikách. |

| Abstract: | The objective of my thesis is to familiarize the reader with the concept of the precautionary principle in the European Union law, specifically its interpretation by ECJ. This principle will be presented both within the theoretical definition, legislative anchoring and practical use in the case-law of the Court of Justice of the EU. First, the thesis analyzes the concept as such - the origin and the first implementation into international treaties and common practice. It also deals with its bases in the legislation of the European Union. Finally, it analyzes the practice itself - through selected types of judicial proceedings before the ECJ, it shows the practical use of this principle in specific cases in thematically different areas. |
