| Abstract: | Diplomová práce se zabývá společným jměním manželů. Cílem této práce je zabývat se největšími změnami, které do úpravy společného jmění manželů přinesl Nový občanský zákoník v kontextu s úpravou předchozí a zhodnotit tuto úpravu z pohledu teorie a praxe, a to na základě odborné literatury. Tato práce rovněž porovnává modifikace, které aktuálně nabízí právní úprava, analyzuje výhody a nevýhody SJM a podrobně rozebírá možnosti vypořádání tohoto jmění. Práce je rozdělena na teoretickou a praktickou část. Teoretická část nejprve shrnuje bývalou právní úpravu, věnuje se změnám v nové právní úpravě oproti té staré a dále navazuje rozbor společného jmění manželů z různých úhlů pohledu a jeho modifikace. Praktická část se věnuje judikatuře, příkladům vypořádání SJM dohodou a ocenění SJM. |

| Abstract: | The Master’s Thesis deals with the common property od spouses (also as “CPOS”). The aim of this work is to deal with the greatest changes that brought the New Civil Code into the regulation of the joint property of the spouses in the context of the previous regulation and to evaluate this modification from the point of view of theory and practice based on specialized literature. This work also compares the modifications currently offered by legislation, analyzes the advantages and disadvantages of the common property of spouses and discusses in detail the possibilities of settling this asset. The thesis is divided into the theoretical and practical part. The theoretical part first summarizes the former legal regulations, deals with changes in the new legal regulations in comparison with the old one, and further analyzes the joint property of spouses from different angles of view and its modification. The practical part deals with the case law, examples of the common property of spouses settlement and the valuation of this asset. |
