| Abstract: | Diplomová práce je zaměřena na právní aspekty ochrany kulturních památek. V teoretické části se zabývá historií právní úpravy ochrany kulturních památek, prameny práva památkové péče v ČR a základními pojmy a organizacemi památkové péče. V další části analyzuje jednotlivé fáze procesu prohlášení věci za kulturní památku a práva a povinnosti vyplývající z vlastnictví nemovité kulturní památky. Poznatky z teoretické části jsou aplikovány na konkrétní národní památce (areálu Janatova mlýna v Buřanech), která je v soukromém vlastnictví. Na základě této aplikace je navržena změna poměru práv a povinností vlastníka kulturní památky. Zároveň práce obsahuje návrh změny procesu prohlášení věci za kulturní památku, tak, aby účastníky tohoto řízení byly i spolky, zabývající se ochranou kulturního dědictví. |

| Abstract: | The Master’s thesis is focused on legal aspects of preservation of cultural monuments. The theoretical part deals with the issue of history and present of heritage protection laws in the Czech Republic and heritage management system there. The next part analyses the individual stages of proceedings of cultural heritage designation as well as the rights and obligations of heritage property owner. The findings of theoretical part are applied in the practical part on the national cultural property (the Janata´s mill in the village Buřany) in private ownership. This application serves the purpose of suggesting change of proportion of the rights and obligations of heritage property owner. The thesis also occasionally mentions recommendations de lege ferenda of the proceedings of the process of cultural heritage designation. |
