| Abstract: | Diplomová práce se zabývá postavením státního zastupitelství v insolvenčním řízení a jeho právní úpravy. Cílem práce je zjistit, zda má státní zastupitelství dostatek práv k hájení veřejného zájmu. Práce je rozčleněna do tří základních částí. První část práce se věnuje teoretickému vymezení základních pojmů souvisejících s insolvenčním řízení a státního zastupitelství v kontextu s insolvenčním řízení. Druhá část práce se pak zaměřuje na postavení státního zastupitelství v insolvenčním řízení, konkrétně na úkony státního zastupitelství v jednotlivých fázích insolvenčního řízení. Na konci jednotlivých kapitol jsou pak uvedeny případy z praxe , které ilustrují konkrétní činnost státního zastupitelství v insolvenčním řízení. Poslední část tvoří praktickou část práce, která se týká zhodnocení postavení státního zastupitelství v insolvenčním řízení a jeho právní úpravy, které je provedeno na základě analýzy případů popsaných v průběhu práce a statistiky činnosti státního zastupitelství v insolvenčním řízení. |

| Abstract: | The diploma thesis deals with the position of public prosecution in insolvency proceedings and its legal regulation. The purpose of this thesis is to determine whether the public prosecution has sufficient rights to defend the public interest. The thesis is divided into three main chapters. The first chapter defines basic terms related to the insolvency proceedings and the public prosecution in the context of the insolvency proceedings. The second chapter of the thesis focuses on the position of the public prosecution in the insolvency proceedings, namely the acts of the public prosecution in the individual stages of the insolvency proceedings. At the end of the individual chapters, there are real cases which demonstrate specific activity of the public prosecution in insolvency proceedings. The last chapter consists of the practical part of the thesis, which deals with the assessment of the position of the public prosecution in insolvency proceedings and its legal regulation, which is made on the basis of an analysis of the cases described during the course of the work and the statistics of the work of the public prosecution in insolvency proceedings. |
