| Abstract: | Tato diplomová práce posuzuje a popisuje aspekty zastupitelské a přímé demokracie v české ústavnosti a tyto porovnává se specifickými charakteristikami přístupu k instrumentům přímé demokracie ve vybraných zemích Evropy. Práce analyzuje současný stav zastupitelské demokracie v České republice, snaží se charakterizovat její současný nestabilní politický status a prostřednictvím historického rozboru popisuje dosavadní průběh, od přijetí ústavní listiny v roce 1920, v problematice zakotvení celostátního referenda do české ústavnosti. Na základě detailního rozboru legislativních návrhů úpravy celostátního referenda v 7. a 8. volebním období a argumentace příznivců a odpůrců přímé demokracie práce přibližuje nejdůležitější prvky parametrizace přímé demokracie způsobující prodlení a rozpory mezi zákonodárci a nastiňuje výraznou opatrnost, která hraničí s účelovým odpíráním práva občanů podílet se na správě věcí veřejných. |

| Abstract: | This diploma thesis is assessing characteristics and aspects of representative and direct democracy in Czech constitutionality and presents a comparison with different constitutional approaches considering variability of statutory regulation of direct demoracy among particular states of Europe. It brings an analysis of present unstable political status of the Czech republic as a representative democracy and presents a historical analysis of legislative statutory proposals for incorporation of direct democracy as a citizen´s right to decide in significant problems, from adoption of a Constitutional document of 1920 up to now. The thesis shows, in detailed analysis of legislative statutory proposals focusing on the 7th and 8th parliamentary terms, the most significant parameters causing delay and disagreement among lawmakers and outlines considerable hesitation bordering with intentional denial of citizen´s right to participate in decision-making in public administration. |
