| Abstract: | Tato diplomová práce se zabývá právní úpravou poskytování zdravotních služeb v České republice. Tato problematika náleží do širšího okruhu zdravotnického práva, které je multidisciplinárním právním oborem a které se dále člení do čtyř oblastí. Poskytování zdravotních služeb spadá do oblasti medicínského (lékařského) práva. Cílem této práce bylo vypracovat komplexní pohled na právní úpravu poskytování zdravotních služeb v České republice, a to zejména s ohledem na interdisciplinární povahu zdravotnického práva, a poskytnout tak ucelený přehled jednotlivých aspektů a institutů poskytování zdravotních služeb, a to jak jednotlivě, tak v jejich vzájemných souvislostech.Z hlediska struktury je práce členěna na úvod, dvanáct samostatných kapitol a závěr. První kapitola se věnuje charakteristice zdravotnického práva. Druhá kapitola je zaměřená na právní předpisy upravující poskytování zdravotních služeb. Třetí kapitola se týká subjektů, které vystupují v souvislosti s poskytováním zdravotních služeb. Čtvrtá kapitola se zabývá právy a povinnostmi pacientů. Pátá kapitola je zaměřena na lidské tělo a s tím související otázky. Šestá kapitola rozebírá institut informovaného souhlasu. Sedmá kapitola se zabývá postupem lege artis. Osmá kapitola se věnuje zdravotnické dokumentaci. Devátá kapitola pojednává o povinné mlčenlivosti ve zdravotnictví. Desátá kapitola se týká občanskoprávní odpovědnosti ve zdravotnictví. Jedenáctá kapitola se věnuje trestní odpovědnosti ve zdravotnictví. Závěrečná dvanáctá kapitola pojednává o disciplinární odpovědnosti ve zdravotnictví. |

| Abstract: | This diploma thesis deals with the legal regulation of provision of health services in the Czech Republic. This issue belongs to a wider area of health law, which is multidisciplinary branch of law and which is further divided into four areas. The provision of health services falls within the area of medical law. The goal of this thesis was to work out a complex view of the legal regulation of provision of health services in the Czech Republic, especially with regard to the interdisciplinary character if health law, and to provide a comprehensive summary of particular aspects and institutes of provision of health services, both individually and in their mutual context.From the point of structure the thesis is divided into introduction, twelve main chapters and conclusion. The first chapter deals with characteristic of health law. The second chapter focuses on legislation regulating the provision of health services. The third chapter concerns the subjects occurring in the context of provision of health services. The fourth chapter deals with rights and duties of patients. The fifth chapter concentrates on human body and related issues. The sixth chapter examines the institute of informed consent. The seventh chapter deals with procedure lex artis. The eighth chapter describes medical records. The ninth chapter deals with medical confidentiality in healthcare. The tenth chapter is focused on civil liability in healthcare. The eleventh chapter describes the criminal liability in healthcare. The final twelfth chapter deals with disciplinary liability in healthcare. |
