| Abstract: | Bakalářská práce se zabývá změnami v právní úpravě institutu oddlužení v České republice. Věnuje se jak proběhlým změnám, které přinesla tzv. akreditační novela, tedy zákon č. 64/2017 Sb., kterým se mění zákon č. 182/2006 Sb., o úpadku a způsobech jeho řešení (insolvenční zákon), především se ale zaměřuje na nadcházející změny, které přinese tzv. oddlužovací novela. Návrh oddlužovací novely vzešel z dílny Ministerstva spravedlnosti a v nedávné době došlo k jeho schválení. Návrh byl podepsán prezidentem dne 30. ledna 2019 a vyhlášen ve Sbírce zákonů pod číslem 31/2019 Sb., účinnosti nabyde 1. června 2019. Cílem této práce je zhodnocení nově přijaté právní úpravy. Práce zhodnotí i změny, které přinesla tzv. akreditační novela. První dvě kapitoly poskytují podstatný úvod do tématu insolvenčního řízení a oddlužení fyzických osob dle aktuální právní úpravy se zhodnocením nejpodstatnějších změn, které přinesla tzv. akreditační novela. Třetí klíčová kapitola se zabývá analýzou schválených změn v institutu oddlužení, tedy změn, které přinese tzv. oddlužovací novela, a jejich možných účinků. |

| Abstract: | The bachelor thesis deals with the amendments to the legal regulation of the debt relief procedure in the Czech Republic, both the amendments that have been brought by the so-called Accreditation Amendment, Act no. 64/2017 Coll., which revises Act no. 182/2016 Coll., On Bankruptcy and Its Resolution (Insolvency Act), but primarily the upcoming amendments, which will bring so-called Debt Relieving Amendment. The draft amendment to the Insolvency Act, so called Debt Relieving Amendment, was submitted by the Ministry of Justice of the Czech Republic and has recently been adopted as the Act no. 31/2019 Coll. It will come into force on the June 1, 2019. The aim of this thesis is to evaluate the newly adopted legislation. Thesis also evaluate the amendments that have been brought by the so-called Accreditation Amendment. The first two chapters provide the essential introduction to the topic of the insolvency proceedings and the debt relief of natural persons analysing the current legal regulation of these institutes. The third key chapter is focused on the analysis of newly adopted legislation. It also analyses its possible impact. |
