| Abstract: | Diplomová práce popisuje postavení bank jako účastníků insolvenčních řízení. V první části diplomové práce jsou představeny základní a klíčové pojmy a instituty, které jsou charakteristické pro insolvenční řízení a jejich pochopení je předpokladem pro následné detailní zkoumání dané problematiky. Druhá část je zaměřena především na popis situace, kdy banka vstupuje do insolvenčního řízení jako věřitel, který v něm uplatňuje svou pohledávku za dlužníkem. Cílem této části diplomové práce je zjistit, zda pro banku budou platit odlišná pravidla v porovnání s ostatními věřiteli, což je následně ověřováno i na reálných datech získaných analýzou insolvenčních řízení, která byla ukončena v letech 2011 až 2013 a v prvním čtvrtletí roku 2018. Poslední, třetí část diplomové práce, je zaměřena na úpadek banky a způsoby jeho řešení. Nejprve jsou představeny teoretické možnosti řešení úpadku jakéhokoli dlužníka a následně jsou zdůrazněna zvláštní pravidla a postupy, které jsou aplikovatelné v případě, že je v insolvenčním řízení řešen úpadek banky. Diplomová práce je zakončena popisem probíhajícího insolvenčního řízení v případě úpadku ERB Bank, který výše zmíněné odchylky od standardní úpravy představuje na praktickém příkladu. |

| Abstract: | This thesis describes position of banks as participants in insolvency proceedings. The first part of this thesis introduces the fundamental and key terms and institutes which are typical for insolvency proceedings and their understanding is prerequisite for the following detailed examination of the matter. The second part of this thesis focuses on describing the situation in which bank enters into insolvency proceedings as creditor who enforces its claim against the debtor. The aim of this part of the thesis is to find out if bank has to follow different rules in insolvency proceedings than other creditors which is subsequently verified by the real outcomes from insolvency proceedings which were terminated between 2011 – 2013 and in the first quarter of the 2018. The last, third part of the thesis focuses on insolvency of bank and on methods of the resolution of the insolvency of bank. First, theoretical possibilities of solving insolvency of any debtor are introduced and then special rules and procedures are emphasised, which are applicable in case of insolvency of the bank. The thesis is concluded by describing ongoing insolvency proceeding in case of insolvency of ERB Bank which examines above mentioned deviations from standard rules on the practical example. |
