| Abstract: | Obsah disertační práce se zabývá problematikou ochrany spotřebitele při uzavírání spotřebitelských smluv prostředky komunikace na dálku. Jedná se o dynamicky se rozvíjející oblast, která s sebou přináší kromě velkého potenciálu rovněž řadu nových otázek. To platí zejména pro oblast tzv. sdílené ekonomiky, ve které vznikají zpravidla vícestranné právní poměry, pro které je uzavírání distančních smluv typické. Vnitrostátní právní předpisy týkající se ochrany spotřebitele jsou ve své podstatě výsledkem transpozice příslušných spotřebitelských směrnic. Stávající transpozice do českého právního řádu vykazují řadu nedostatků, které nepříznivě ovlivňují míru ochrany spotřebitelů. Cílem disertační práce je přispět k řešení problémů právní úpravy související s uzavíráním spotřebitelských smluv prostředky komunikace na dálku, především zkoumáním vybraných soukromoprávních nástrojů ochrany spotřebitele v právním řádu ČR. Práce se v rámci interpretace jednotlivých soukromoprávních norem zaměřuje hlavně na zkoumání a analýzu míry transpozice příslušných spotřebitelských směrnic. Součástí této analýzy jsou rovněž spotřebitelské právní poměry vznikající ve sdílené ekonomice a jejich specifika.Text disertační práce je doplněn o relevantní judikaturu Sodního dvora EU a vnitrostátních soudů. |

| Abstract: | The content of this thesis is focused on the issue of consumer protection in concluding consumer contracts by using the means of distance communication. Because it is a dynamically developing area with great potential, it also brings a number of questions. The new questions brings the area of the sharing economy, in which multilateral legal relations usually arise and for which the concluding the distance contracts is typical, as well.In essence, the national consumer protection legislation is the result of transposition of the relevant consumer directives. The current transpositions into the Czech legal system contain a number of shortcomings which adversely affect the level of consumer protection.The aim of the thesis is to contribute the solving issues of legislation related to the concluding consumer contracts by using the means of distance communication, especially by examining selected private-law consumer protection instruments in the Czech legal order. The thesis focuses on the analysis of the transposition of relevant consumer directives within the framework of the interpretation of private law legal rules. Consumer legal relationships arising in the sharing economy and their specifics are also part of this research.The text of the thesis is supplemented by relevant decisions of the European Court of Justice and national courts. |
