| Abstract: | Tato diplomová práce se zabývá analýzou účastenství v řízeních před SDEU, především pak v řízení o předběžné otázce a v řízení o porušení Smlouvy. Přičemž se snaží, při uplatnění konkrétních případů účastenství České republiky v uvedených řízeních, tuto problematiku více přiblížit a vysledovat jistý systematický postoj tohoto státu a jeho zájmů. Práce je rozdělena do šesti kapitol. V rámci teoretické části je v první kapitole vymezena funkce vládního zmocněnce a jeho úloha u SDEU a dále je zde vyložen pojem národního zájmu. Druhá kapitola pojednává o řízení o předběžné otázce, přesněji co je předmětem tohoto řízení, jaký je průběh řízení a jaké účinky má vydané rozhodnutí v tomto řízení. Třetí kapitola přibližuje problematiku řízení o porušení Smlouvy, její předsoudní fázi, aktivní legitimaci a účinky vydaného rozhodnutí. Na konci teoretické části, tedy v rámci čtvrté kapitoly, je shrnut institut tzv. vedlejšího účastenství. Na teoretickou část pak navazuje ta praktická, jež se zabývá konkrétními případy účastenství České republiky, a to jak v rámci řízení o předběžných otázkách, tak v řízení o porušení Smlouvy či v ostatních řízeních. Vybrané případy jsou krátce popsány a shrnuta stanoviska, která byla v dané věci předkládána Českou republikou. Z uvedených stanovisek jsou poté učiněny závěry ohledně systematiky obhajoby národních zájmů České republiky. |

| Abstract: | This diploma thesis deals with the analysis of participation in proceedings before the CJEU, especially in preliminary ruling proceedings and infringement proceedings. While analysing specific cases of participation of the Czech Republic in these proceedings, it tries to describe this issue and find out a certain systematic attitude of this state and its interests. The thesis is divided into the six chapters. In the theoretical part, the first chapter defines the function of the Government Commissioner and his role before the CJEU and the concept of national interest. The second chapter deals with the reference for a preliminary ruling, more precisely what is the subject of the present proceedings, what is the course of the proceedings and what effects have the decision issued in these proceedings. The third chapter describes the issue of infringement proceedings, its pre-trial phase, locus standi and the effects of the issued decision. At the end of the theoretical part, ie within the fourth chapter, the institute of so-called intervention is summarized. The theoretical part is followed by the practical part, which deals with specific cases of participation of the Czech Republic, both in the preliminary ruling proceedings, in the infringement proceedings or in other proceedings. The selected cases are briefly described and summarized in the opinions submitted by the Czech Republic in this matter. The conclusions are then drawn from the above-mentioned opinions on the system of defense of the Czech Republic's national interests. |
