The Right to Family Reunification in the European and International Law

The topic of this thesis serves to present the issue of the basic human right to family life and the connected practical instrument of the family reunification.The main target is to describe the decision-making process of two European courts, CJEU and ECHR in their case-law practise within the consideration of the issue of defining the law on family life and family reunification. Above that to compare and summarize of the evaluation what the main differences and main conformities of each other decision-making approach are. The emphasis is given to the critical approach of both courts on the subject and their deep explication of the issue, which is described in the international law in general sense. The thesis is divided into two parts. First of them is aiming to the theoretical approach to the subject as it is included in the international human rights conventions concerning the human right to family life and family reunification. The same approach will be applied to the basis and principals of the EU law. The second part will present the selected case-law of both courts concerning the definition of the family and family reunification. The cases will be deeply analysed and the general remarks and conclusions will be provided to get information about the attitudes of both courts. The conclusions will serve to provide comparison of the attitude of the courts to demonstrate their conformities and divergences in the opinion on this topic issue.
