| Abstract: | Cílem této diplomové práce je analýza insolvenčního řízení od účinnosti zákona č. 182/2006 Sb., o úpadku a způsobech jeho řešení, až do roku 2018. Práce uvádí, zda domácnosti v úpadku využívají oddlužení a podniky v úpadku konkurs či reorganizaci. Záměrem práce je zhodnocení situace v České republice a určení dopadů insolvenčního řízení na domácnosti a na národní hospodářství. Výrazný počet osob v exekucích značí problém se solventností domácností a práce ukazuje, zda je řešením oddlužení. Práce se v teoretické části nejprve věnuje zadluženosti domácností a podniků a poté pojmům souvisejících s insolvenčním řízením. V praktické části je analýza domácností v úpadku a komparace osob v oddlužení s počtem osob v exekuci. Oddlužovací novela nastavila podmínky, které by měli umožnit vstup do insolvence více dlužníkům. Praktická část představuje důvody podniků v úpadku při využívání konkursu před reorganizací. Jedním z dopadů insolvenčního řízení je vliv na státní rozpočet země. Hlavním přínosem práce je komplexní analýza všech typů insolvenčních řízení a výpočet průměrné výše ztráty za insolvenční řízení. |

| Abstract: | The aim of this diploma thesis is the analysis of insolvency proceedings from the effect of Act No. 182/2006 Coll., on bankruptcy and the way of its solution, until 2018. The thesis states whether households in bankruptcy use debt relief and companies in failure use bankruptcy or reorganization. Purpose of thesis is the evaluation of the situation in the Czech Republic and determination of the impacts of insolvency proceedings on households and on the national economy. A significant number of persons in distraints indicate a problem with the solvency of households and work shows whether personal bankruptcy is the solution. In the theoretical part, the thesis deals first with the indebtedness of households and companies and then with terms related to insolvency proceedings. In the practical part is analysis of households in bankruptcy and comparison of persons in debt relief with the number of persons with distraints. The amendment of insolvency law has set conditions that should allow more debtors to enter insolvency. The practical part introduces the reasons of the companies in failure when using bankruptcy before reorganization. One of the impacts of insolvency proceedings is the impact on the state budget of the country. The main benefit of this thesis is a comprehensive analysis of all types of insolvency proceedings and calculation of the average amount of loss for insolvency proceedings. |
