| Abstract: | Bakalářská práce pojednává o francouzském zákonu, který zakázal zahalování obličeje na veřejnosti. Cílem práce je zodpovězení výzkumné otázky stanovené takto: „Shodoval se rozsudek Evropského soudu pro lidská práva s argumentací Výboru pro lidská práva ohledně zákazu nošení burek na veřejnosti ve Francii?“. V první kapitole je představeno muslimské náboženství a jeho tradice s důrazem na zahalování. Druhá kapitola vymezuje pojem náboženská svoboda a právo na náboženskou svobodu. Třetí kapitola sleduje diskuse a proces přijímání předmětného francouzského zákona. V poslední kapitole je analyzován rozsudek Evropského soudu pro lidská práva společně se stanoviskem Výboru pro lidská práva. Jejich argumentace jsou následně porovnány. Závěrem práce dochází ke zjištění, že se v tomto případě tyto dva orgány neshodují. |

| Abstract: | The Bachelor thesis deals with the French law, which has prohibited face-concealing in public. The aim of this thesis is to answer the research question: „Is the judgement of the European Court of Human Rights the same as the Views adopted by the Human Rights Committee about the French burqa ban in public? Muslim religion and its tradition, primarily concealing, are introduced in the first chapter. The second chapter defines the term of religious freedom and law on religious freedom. The third chapter observes discussions and acceptance of the object law. The judgement of the European Court of Human Rights and Views adopted by the Human Rights Committee are analysed and compared in the last chapter. In conclusion, it is found that their opinions in this case differ. |
