| Abstract: | Cílem této diplomové práce je zjistit problematické otázky právní úpravy týkající se autobusové dopravy a zhodnotit efektivnost a nastavení úpravy relevantních oblastí soutěžního práva na evropské úrovni, ve Spolkové republice Německo (SRN) a České republice (ČR), jak z hlediska právní úpravy, tak z hlediska právní praxe. Práce se nejprve v první kapitole zabývá charakteristikami osobní autobusové dopravy. V následující kapitole se věnuje soutěžnímu právu a detailněji pak problematice spojování soutěžitelů a zneužití dominantního postavení. V další části práce popisuje vývoj v oblasti autobusové dopravy ve Spolkové republice Německo, zejména v souvislosti se spojováním soutěžitelů. Čtvrtá kapitola se zaměřuje na Českou republiku a oblast zneužití dominantního postavení. Závěrečná část práce se pak věnuje budoucímu vývoji. |

| Abstract: | The goal of the diploma thesis is to identify problematic issues in regards to bus transport legislation and to evaluate the effectiveness and setting of relevant areas of competition law at the European level, in the Federal Republic of Germany and in the Czech Republic both in terms of legislation and legal practice. The thesis in the first chapter deals with the characteristics of passenger bus transport. The following chapter is concerned with competition law and analyzes in greater detail the issue of mergers and abuse of dominant position. The next section of the thesis describes the development of the field of bus transport in the Federal Republic of Germany, especially in connection with the merger of competitors. The fourth chapter focuses on the Czech Republic and the area of abuse of dominant position. The final part of the thesis then deals with possible future development. |
