| Abstract: | Diplomová práce se zabývá institutem české národní ochranné známky v kontextu nedávné novelizace související právní úpravy účinné od 1. ledna 2019. Jedná se o zákon č. 286/2018 Sb., novelizující zákon č. 441/2003 Sb., o ochranných známkách, ve znění pozdějších předpisů, kterým byl do českého právního řádu implementován obsah směrnice Evropského parlamentu a Rady (EU) 2015/2436 ze dne 16. prosince 2015, kterou se sbližují právní předpisy členských států o ochranných známkách. Hlavním cílem této práce je zhodnocení provedených změn právní úpravy institutu národní ochranné známky v České republice. První kapitola poskytuje nezbytný úvod do oblasti českého známkového práva. Další kapitoly se postupně zabývají dílčími úseky právní úpravy institutu národní ochranné známky ve světle provedených legislativních změn. |

| Abstract: | The thesis deals with the concept of Czech trademark considering the recent amendments to the Czech trademark law effective as of 1 January 2019. Act Nr. 286/2018 Coll., amending Act Nr. 441/2003 Coll., on Trademarks, has transposed Directive (EU) 2015/2436 of the European Parliament and of the Council of 16 December 2015 to approximate the laws of the Member States relating to trade marks into Czech national law. The major aim of this thesis is to evaluate the newly adopted legislation. The first chapter provides the essential introduction to the national trademark concept. Further chapters provide the analysis of the components of national trademark legislation in the Czech Republic in light of the implemented changes. |
