| Abstract: | Kryptoměny za dobu své relativně krátké existence prokázaly svou užitečnost jakožto nová technologie a finanční instrument. Překonaly i mnoho regulatorních nástrah. Jejich výrazná cenová volatilita, technologicky komplikovaný ráz a stále ještě nedostatečný regulatorní rámec jsou jen některými z překážek v cestě k široké implementaci na finančních trzích a k adopci veřejností. Pro použití kryptoměn v každodenním životě bude nutno dosáhnout kompromisu mezi regulátory a tvůrci zejména těch nejvíce decentralizovaných kryptoměn. Oblastmi, které je zapotřebí důsledně regulatorně upravit, jsou ochrana investorů a uživatelů kryptoměn, dále pak zamezení praní špinavých peněz a financování terorismu pomocí kryptoměn. Nedořešená zůstává i problematika zdanění. Tyto oblasti jsou zejména v Evropské unii považovány za klíčové. Dokud nebudou jasně a přesně regulatorně ošetřeny, je v mnoha zemích EU vznik krypto investičních Fondů kvalifikovaných investorů velmi komplikovaný a v České republice zcela nemožný.Tato práce shrnuje dosavadní regulatorní nařízení v oblasti kryptoměn v USA, EU a v ČR a diskutuje, co je nutné upřesnit, aby byl umožněn vznik krypto investičních Fondů kvalifikovaných investorů v České republice. |

| Abstract: | During their relatively short history, cryptocurrencies have overcome many scrupulous regulatory hurdles and shown their utility as new technology and financial instrument. Their high price volatility, technological complexity, and still unfinished regulatory framework are just some barriers still standing between cryptocurrencies and wide adoption by the public. In order to enable the usage of cryptocurrencies in everyday life, a consensus between crypto regulators and crypto makers will have to be reached. The most important areas where detailed regulation is required are the investor and consumer protection, anti-money laundering efforts, combating the financing of terrorism and also taxation. These areas are regarded as key in European Union and until they are sufficiently regulated, the creation of qualified investors crypto funds is extremely complicated in the EU and not possible at all in the Czech Republic. This thesis is summarizing the current crypto regulatory framework in the USA, EU, and the Czech Republic. It also discusses where it needs improvement in order to enable the creation of qualified investors crypto funds in the Czech Republic. |
