| Abstract: | Předložená diplomová práce se věnuje kolektivní správě práv autorských v oblasti výtvarného umění na území České republiky. Práce je zaměřena na zobrazovací výtvarné umění, zejména na malířství, sochařství a fotografii. Teoretická část využívá informace zjištěné z primárních zdrojů a rovněž z dostupné právní literatury věnující se autorskému právu. Práce neusiluje o vyčerpávající právní výklad, důraz je kladen zejména na srozumitelnost a uchopitelnost tématu pro neprávníky. Praktická část vychází z analýzy výročních zpráv, účetních výkazů, informací a dokumentů dostupných na webových stránkách kolektivních správců působících v oblasti výtvarného umění, kterými jsou GESTOR a OOA-S. Tyto údaje jsou doplněny rozhovory s ředitelem kolektivního správce GESTOR JUDr. Antonínem Janákem, odborníkem na kapitálové trhy Mgr. Jiřím Mařasem a spolumajitelem rodinné galerie a aukčního domu Arthouse Hejtmánek Tomášem Hejtmánkem a informacemi zjištěnými z dotazníkového šetření mezi obchodníky s uměním. Práce kriticky hodnotí činnost kolektivního správce GESTOR a předkládá návrhy pro zlepšení. |

| Abstract: | Presented master thesis is covering a topic of collective management of copyright law in the field of visual arts in the Czech Republic. The thesis is focused on visual arts, especially painting, sculpture and photography. The theoretical framework uses available law literature concerning copyright law to explain the key concepts and lay the foundations that will support further analysis. The thesis does not aim to provide exhaustive legal interpretation, but it focuses on intelligibility and usability for non-lawyers. The practical part is focused on copyright management organizations active in the field of visual arts, which are GESTOR and OOA-S. It includes analysis of annual reports, financial statements, data and documents obtained from the collective management organization‘s websites. This data is complemented by interviews with the director of collective management organization GESTOR JUDr. Antonín Janák, capital market expert Mgr. Jiří Mařas and the co-owner of the gallery and auction house Arthouse Hejtmánek Tomáš Hejtmánek and information obtained from questionnaire sent to selected art entrepreneurs. In conclusion the thesis critically evaluates the operation of the collective management organization GESTOR and proposes ideas for its improvement. |
