| Abstract: | Tato diplomová práce řeší institut předžalobní výzvy, která vznikla novelou občanského soudního řádu. Zabývá se jejím zakotvením v českém právním řádu, a zároveň problémy, které z něj vyplývají. Součástí práce je i porovnání fungování tohoto institutu v Ruské federaci. Vyhodnocení probíhalo na základě syntézy dostupné literatury několika autorů, kteří svůj pohled v této věci prezentovali. V poslední části je zmíněno, jaké náklady vzniknou věřiteli s vymáháním pohledávek, v případě, že předžalobní výzva není úspěšná a věřitel je nucen obrátit se se žalobou na soud. Rovněž také statistika ohledně vymáhání pohledávek v rámci České republiky a Ruska. |

| Abstract: | This diploma thesis deals with the institute of a final reminder of outstanding debts, which was created by an amendment to the Civil Procedure Code. Its aim is to analyse the position of the final reminder of outstanding debts in the Czech legal system and to identify the problems arising from it. This thesis also includes a comparison of the functioning of the institute with Russian Federation. The evaluation was based on a synthesis of available literature by several authors who presented their views on the matter. The last part mentions the costs incurred by the creditor with the recovery of receivables if the final reminder of outstanding debts is not successful and the creditor is forced to file a lawsuit. Also, statistics on debt collection in the Czech Republic and Russia. |
