| Abstract: | Hlavním cílem této diplomové práce na téma „Zaměstnávání cizinců v České republice“ je shrnutím současné platné právní úpravy, týkající se pobytu a zaměstnávání cizinců v České republice, a to jak pro cizince ze zemí členských státu EU/EHP a Švýcarska a jejich rodinných příslušníků, tak pro cizince pocházejících ze třetích států, a to z toho důvodu, že pro každou z těchto skupin cizinců platí podle českého práva jiný režim. Práce je rozdělena na dvě hlavní části, první je teoretická část a druhou je pak část praktická. V první kapitole v teoretické části jsou definovány nejpodstatnější pojmy, které souvisí s touto prací. Jedná se zejména o pojem cizinec, občan EU/EHP a Švýcarska a jejich rodinní příslušníci, zaměstnávání, zaměstnanec a zaměstnavatel. Druhá kapitola se zaměřuje na jednotlivé typy pobytů u cizinců, a to jak u cizinců ze členských státu EU/EHP a Švýcarska, tak u cizinců ze třetích zemí. Třetí kapitola rozebírá jednotlivé rozdíly mezi zaměstnáváním cizinců z EU/EHP a Švýcarska a cizinců ze třetích zemí. Dále se v této kapitole zaměřím na "nostrifikaci", neboli proces uznávání zahraničního vysokoškolského vzdělání a kvalifikace jako rovnocenného se vzděláním získaným v České republice. Poslední část teoretické části se zaměřuje na povinnosti zaměstnavatelů při zaměstnáním cizinců. V praktické části práce je proveden dotazníkový průzkum a byl zacílen na cizince pobývající na území České republiky za účelem práce. Cílem dotazníkového průzkumu bylo zjištění administrativní zátěže a odpovědnosti za jednotlivé procesy při vyřizování pracovního povolení cizince žijícího a pracujícího na území České republiky. |

| Abstract: | The main goal of this diploma thesis on "Employment of foreigners in the Czech Republic" is a summary of current legislation concerning the residence and employment of foreigners in the Czech Republic, both for foreigners from EU / EEA Member States and Switzerland and their family members, thus for foreigners from third countries, due to the fact that for each of these groups of foreigners a different regime applies under Czech law. The work is divided into two main parts, the first is the theoretical part and the second is the practical part. The first chapter in the theoretical part defines the most important terms related to this work. These include, in particular, the concept of foreigner, EU / EEA and Swiss citizen and their family members, employment, employee and employer. The second chapter focuses on individual types of stays for foreigners, both for foreigners from EU / EEA Member States and Switzerland, and for foreigners from third countries. The third chapter discusses the various differences between the employment of foreigners from the EU / EEA and Switzerland and foreigners from third countries. Furthermore, in this chapter I will focus on "nostrification", or the process of recognizing foreign higher education and qualifications as equivalent to education obtained in the Czech Republic. The last part of the theoretical part focuses on the obligations of employers in the employment of foreigners. In the practical part of the work, a questionnaire survey is conducted and was aimed at foreigners residing in the Czech Republic for the purpose of work. The aim of the questionnaire survey was to determine the administrative burden and responsibility for individual processes in processing the work permit of a foreigner living and working in the Czech Republic. |
