| Abstract: | Tato diplomová práce se zabývá úpravou povinných úkolů samosprávy v legislativách vybraných států Německa, Rakouska a České republiky. Legislativa České republika neupravuje tento pojem, nicméně samosprávy vykonávají povinně také jisté úkoly. Práce komparativně srovnává úpravu těchto úkolů v Rakousku a Německu a hodnotí, zda by bylo vhodné tyto úkoly umístit také do českých právních předpisů. V teoretické části byly vymezeny právní základy samospráv, jejich vývoj a historie, působnosti. Práce dále pojednává o veřejných službách a jejich poskytovatelích. Část je věnována rozpočtu obcí. V praktické části je provedena komparace povinných úkolů, z pohledu financování, míry povinnosti, standardů kvality, v již zmíněných zemích. Na základě provedených analýz a komparací lze definovat povinné úkoly, které by i Česká republika mohla umístit do své legislativy. Práce dochází k závěru, že by měly být stanoven lépe rozsah poskytovaných úkolů a jisté standardy kvality, které by do budoucna mohly zajistit efektivnější využití finančních prostředků. Dále by měla být nastavena kontrola a soudní vymahatelnost plnění těchto úkolů. |

| Abstract: | This diploma thesis deals with the regulation of mandatory tasks of self-government in the legislation of selected states of Germany, Austria and the Czech Republic. The Czech Republic does not regulate this concept, however, local governments are also obliged to perform certain tasks. The work comparatively compares the regulation of these tasks in Austria and Germany and evaluates whether it would be appropriate to place these tasks in Czech legislation. The theoretical part defined the legal bases of local governments, their development and history, scope. The work also deals with public services and their providers. Part is devoted to the budget of municipalities. The practical part is a comparison of mandatory tasks, in terms of funding, degree of obligation, quality standards, in the countries already mentioned. Based on the performed analyzes and comparisons, it is possible to define obligatory tasks that the Czech Republic could also place in its legislation. The work concludes that the scope of tasks provided and certain quality standards should be better defined, which could ensure a more efficient use of funds in the future. In addition, control and enforcement of these tasks should be established. |
