| Abstract: | Práce se zaměřuje na imunitu členů Evropského parlamentu (EP) a řízení o zbavování imunity. Jejím cílem je určit, zda rozhodování EP ve věcech imunity je ovlivněno i jinými faktory, než je vydávací praxe, a to konkrétně hrozící sankcí a postojem stíhaného poslance. Nejprve je definován institut imunity a výsad a popsána platná právní úprava imunity členů EP. Poté je představeno imunitní řízení jeho teoretická procesní stránka i vývoj reálné praxe. Ve třetí kapitole jsou analyzována imunitní řízení z let 2016-2019 dle důvodu, pro který se o poslancově imunitě jedná (dopravní přestupek, podvodné jednání, pomluva, podněcování k nenávisti či jiné provinění). V drtivé většině případů byli poslanci vydáni, a to zejména pokud se jednalo o drobné nepolitické trestné činy a přestupky či naopak o závažnější provinění. Čím vyšší hrozící sankce je, tím roste i délka samotného imunitního řízení. Pokud poslanec souhlasí se svým vydáním, EP zpravidla jeho přání vyslyší. V opačných případech však souvislost mezi poslancovým postojem a výsledkem imunitního řízení zpozorovat nelze. |

| Abstract: | The bachelor thesis focuses on immunity of members of the European Parliament (EP) and waiver of immunity procedure. Its aim is to determine whether decisions of EP on immunity are influenced among general practice by other factors, such as potential punishment or member`s stand. First of all, immunity and privileges are defined, as well as the current legal framework of immunity of members of EP. Then, procedure on immunity is described from both theoretical and practical point of view. Third chapter analyses the procedures on immunity from 2016 to 2019, which are divided into five groups according to reason for proceedings (traffic offence, fraud, defamation, incitement to hatred or other offence). Immunity was waived in the majority of cases, especially in those concerning minor and clearly non-political crimes and serious allegations. The more severe penalty, the longer procedure on immunity can be expected. EP respects the stand of prosecuted member as long as agreement with waiver of immunity is expressed. Otherwise, EP usually does not take member`s stand into account. |
