Liability insurance for damage caused by members of the board and other managers

Témou tejto diplomovej práce je poistenie zodpovednosti za škodu spôsobenú členmi štatutárnych orgánov a ďalšími manažérmi, tzv. poistenie D&O. Práca sa v prvej polovici sústredí na teoretický základ, z ktorého dané poistenie plynie. Zároveň sú rozobrané špecifiká tohto poistenia a to najmä v rozsahu krytia, parametroch a štruktúre poistenia. Jedným z cieľov práce je porovnať a vyhodnotiť rozsah krytia poistenia D&O u piatich vybraných poisťovní, v rámci ktorých sú zastúpene najväčšie tradičné poisťovne na českom trhu, ale aj zahraniční poistitelia. Druhá polovica práce je venovaná modelovému prípadu škody, kde na konkrétnom vznesenom nároku je ukázaná úloha poistenia D&O pre podnikateľský subjekt. Posledná kapitola popisuje reakciu poistného trhu na zhoršenú aktuálnu ekonomickú situáciu vo svete kvôli pandémii ochorenia Covid-19 a ilustruje vývoj poistných sadzieb finančných rizík kam patrí aj poistenie D&O za posledné roky.

The topic of this diploma thesis is liability insurance for damage caused by members of the board and other managers, the so-called D&O insurance. In the first half, the thesis focuses on the theoretical basis from which the insurance derives. At the same time, the specifics of this insurance are discussed, especially in the scope of coverage, parameters and structure of the insurance. One of the aims of this work is to compare and evaluate the scope of D&O insurance coverage for five selected insurance companies, which represent the largest traditional insurance companies on the Czech market, as well as foreign insurers. The second half of the thesis is devoted to a model case of damage, where the role of D&O insurance for a business entity is shown on a specific claim. The last chapter describes the reaction of the insurance market to the worsened current economic situation in the world due to the Covid-19 pandemic and illustrates the development of financial risk rates, which includes D&O insurance, in recent years.
