| Abstract: | Tato diplomová práce se zabývá alternativními způsoby řešení sporů v obchodních vztazích se zaměřením na mediaci. Cílem diplomové práce je posoudit, zda je úprava mediace obsažená v zákoně č. 202/2012 Sb., o mediaci a o změně některých zákonů, vhodná pro řešení obchodních sporů. Diplomová práce analyzuje vhodné alternativní způsoby řešení obchodních sporů se zaměřením na mediaci dle české právní úpravy. Dále také zkoumá znaky, kterými se vyznačuje mediace v obchodních sporech. V diplomové práci jsou rozebrána i mediační pravidla mediačních center při WIPO a ICC. Na základě zjištěných poznatků jsou v diplomové práci uvedena doporučení pro rozšíření mediace nejen v obchodních sporech v podmínkách české právní úpravy. |

| Abstract: | This diploma thesis deals with the alternative resolutions of commercial disputes with a focus on mediation. The aim of the diploma thesis is to assess whether the regulation of mediation contained in Act No. 202/2012 Coll., On Mediation and Change of some Laws (Mediation Act), is suitable for resolving commercial disputes. The diploma thesis analyses suitable alternative ways of resolving commercial disputes with a focus on mediation under the Czech Mediation Act. It also examines the characteristics of mediation in commercial disputes. The diploma thesis examines the mediation rules of the WIPO and ICC mediation centres. Based on the findings, the diploma thesis contains recommendations for the expansion of mediation not only in commercial disputes in the conditions of the Czech law. |
