Selection of an appropriate legal form for a private language school in the Czech Republic

| Abstract: | Diplomová práce se zabývá výběrem vhodné právní formy soukromé jazykové školy bez práva státní jazykové zkoušky v České republice. Zaměřuje se na charakteristiku jednotlivých právních forem podnikání z pohledu sedmi klíčových kritérií, díky kterým je komparuje pro jejich možné využití u soukromé jazykové školy. V rámci práce byl vytvořen pro zakladatele soukromých jazykových škol dotazník, jehož cílem bylo potvrdit či vyvrátit předem stanovené hypotézy sloužící k naplnění hlavního cíle. Výzkumný vzorek tvořilo celkem více než sto provozovatelů soukromých jazykových škol v ČR. Díky výsledkům dotazníkového šetření bylo zjištěno, že drtivá většina soukromých jazykových škol podniká jako fyzická osoba nebo s.r.o. a také, že při rozhodování je ovlivňovala zejména náročnost založení dané formy, výše administrativní zátěže a míra podnikatelského rizika. Nejvhodnějšími právními formami pro soukromou jazykovou školu byly shledány na základě komparace právních forem z hlediska sedmi faktorů dvě neziskové právnické osoby. Pakliže by byl ale brán ohled pouze na právní formy s hlavním účelem podnikání, na prvním místě by se umístila fyzická osoba a na druhém společnost s ručením omezeným. Výsledek srovnání tedy nakonec prakticky odpovídal zjištění dotazníkového šetření. |

| Abstract: | The diploma thesis deals with the selection of a suitable legal form of a private language school without the right to a state language exam in the Czech Republic. It focuses on the characteristics of individual legal forms of business in terms of seven key criteria, which allow us to compare them for their possible use for a private language school. Another part of the thesis is a questionnaire which was created for the founders of private language schools and should confirm or reject the predetermined hypotheses used to reach the main goal. The research sample consisted of a total of more than a hundred founders of private language schools in the Czech Republic. Thanks to the results of the questionnaire survey, it was found that the vast majority of private language schools operate as a natural person or a limited liability company; and that the decision-making process was influenced mainly by the simplicity of the establishment of the legal form, the complexity of administration and the level of business risk. Finally, two non-profit legal forms were found to be the most suitable legal forms for a private language school on the basis of a comparison of legal forms in the terms of seven factors. However, if only the legal forms with the main purpose of the business were taken into account, the natural person would take the first place and the limited liability company the second one. Thus, in the end, the results of the comparison actually corresponded to the findings of the questionnaire survey. |
