| Abstract: | Diplomová práce se zabývá vybranými zvláštními prvky právní úpravy sporů o pravost, výši a pořadí pohledávek uplatněných v insolvenčním řízení. Platnou právní úpravu hodnotí zejména z hlediska práva na spravedlivý proces a základních zásad civilního sporného řízení. První kapitola se zabývá oprávněním podat žalobu. Druhá kapitola se věnuje lhůtám k podání žaloby. Třetí kapitola se zaměřuje na povinnost složit jistotu na náklady řízení nebo náhradu škody. Čtvrtá kapitola se soustředí na možné dispozice s předmětem řízení. Pátá kapitola je věnována břemenu tvrzení. Šestá kapitola se zabývá důkazním břemenem. |

| Abstract: | The diploma thesis deals with selected special aspects of the legal regulation of disputes concerning the authenticity, amount and order of claims filed in insolvency proceedings. It evaluates the current legislation, especially in terms of the right to a fair trial and the basic principles of civil proceedings. The first chapter deals with the entitlement to sue. The second chapter deals with the time limits for bringing an action. The third chapter focuses on the obligation to lodge a security for litigation costs or damages. The fourth chapter focuses on the possible dispositions with the subject-matter of the proceedings. The fifth chapter is devoted to the burden of allegation. The sixth chapter deals with the burden of proof. |
