| Abstract: | Tato práce analyzuje reorganizace v České republice v rozmezí let 2009 až 2021. Práce nejprve představuje teoretické a legislativní předpoklady insolvenčního řízení v České republice. Analyzovány jsou reorganizace, u kterých insolvenční soud schválil reorganizační plán. Reorganizace jsou analyzovány na základě struktury věřitelů, složení jejich pohledávek, uspokojení pohledávek a také z pohledu samotného důvodu pro zahájení insolvenčního řízení. Práce poukazuje na nerovné rozdělení fyzického počtu věřitelů v závislosti na charakteru zajištění či nezajištění jejich pohledávek, na vliv uspokojení pohledávek na úspěšnost reorganizačního procesu. Výzkum reorganizací vychází z veřejně dostupných dat o insolvenčních řízeních dostupných z insolvenčního rejstříku. Z výsledku je patrné, že reorganizace je pro dlužníka i věřitele výhodnější než druhá možnost řešení úpadku podnikatelských subjektů, kterou je konkurs. Zdárné řešení reorganizace podporuje přítomnost bankovních domů v roli věřitele. Jsou to právě věřitelé, na jejichž uspokojení do značné míry závisí výsledek reorganizace. |

| Abstract: | This work analyzes reorganizations in the Czech Republic between 2009 and 2021. The work first presents the theoretical and legislative prerequisites of insolvency proceedings in the Czech Republic. Reorganizations for which the bankruptcy court approved the reorganization plan are analyzed. Reorganizations are analyzed based on the structure of creditors, composition of their claims, satisfaction of claims and also from the point of view of the very reason for starting insolvency proceedings. The thesis points to the unequal distribution of the physical number of creditors depending on the nature of securing or not securing their claims, the influence of the satisfaction of claims on the success of the reorganization process. Research on reorganizations is based on publicly available data on insolvency proceedings available from the insolvency register. The result shows that reorganization is more advantageous for both the debtor and the creditor than the second option for solving the bankruptcy of business entities, which is bankruptcy. The apparent solution to the reorganization supports the presence of banking houses in the role of lender. It is precisely the creditors on whose satisfaction the outcome of the reorganization largely depends. |
