| Abstract: | Hlavní cílem diplomové práce je objasnit institut svěřenského fondu a jeho fungování. Dílčím cílem práce je na praktických příkladech ukázat, že institut není jen nástrojem pro bohaté a politiky, ale i pro obyčejné lidi. Institut, jehož počátky můžeme v rámci českých zemí datovat do 19.století, zažívá velký návrat. Tento institut se stává populárnější nejen v rámci efektivní ochrany a kontroly majetku, ale také jeho růstu. Ač institut mezinárodně populární, v rámci českého právního řádu má řadu nedostatků. První část práce se zaměří na historický vývoj tohoto institutu v rámci římského práva, common law i vývoj český. Další část se zaměří na samotnou úpravu svěřenských fondů v občanském zákoníku a jeho samotné fungování. Třetí část zhodnotí nedostatky aktuální úpravy a přiblíží další relevantní právní úpravu. Závěr diplomové práce názorně představí možné praktické využití svěřenského fondu jak nástroje pro ochranu majetku, tak pro jeho efektivní správu v běžných životních situacích. |

| Abstract: | The main goal of the thesis is to clarify the institute of the trust fund. The partial goal of the thesis is to show, using practical examples, that the institute is not only a tool for the rich and politicians, but also for ordinary people. The institute whose beginnings in the Czech lands can be dated back to the 19th century, is experiencing a major comeback. This institute is becoming more popular not only as an effective protection and control of property, but also as a tool for growth of wealth. Although the institute is internationally popular, it has several shortcomings within the Czech legal system. The first part of the thesis will focus on the historical development of this institute within the framework of Roman law, common law and Czech development. The next part will focus on the regulation of trust funds in the Civil Code and its functioning. The third part will evaluate the shortcomings of the current regulation and present other relevant legal regulations. The conclusion of the diploma thesis will illustrate the possible practical use of the trust fund as a tool for property protection and its effective management in ordinary life situations. |
