| Abstract: | Předložená práce se zabývá problematikou dopadů nově vznikajících norem v oblasti životního prostředí na jednu skupinu adresátů daných právních norem, kterými jsou podnikatelé ve stavebnictví. Práce se bude zabývat důsledky klimatických změn pro oblast stavebnictví, včetně dopadu na stabilitu právního systému a právní důvěru a dopadu na jednu skupinu adresátů daných právních norem, kterými jsou podnikatelé ve stavebnictví. Vzhledem k tomu, že jsou zaváděny nové předpisy a normy na podporu výstavby udržitelnějších a ekologičtějších budov, je důležité, aby právní rámec podporující tyto změny byl stabilní a konzistentní. To může podnikatelům poskytnout jistotu a důvěru, kterou potřebují k efektivnímu fungování, a může to pomoci podpořit přechod k udržitelnějším stavebním postupům. Pokud je však právní rámec nestabilní nebo nejednotný, může to u podnikatelů vyvolat nejistotu a nejistotu, což jim může ztížit úspěšné působení v oblasti výstavby budov. Tato práce si klade za cíl posoudit, která z analyzovaných národních úprav je pro podnikatele ve stavebnictví celkově příznivější. Zaměřuje se nejprve na právní úpravu na unijní úrovni a dále na úrovni dvou vybraných členských států, kterými je Česká republika a Spolková republika Německo. Práce je rozdělena na pět hlavních kapitol, přičemž poslední kapitola se zabývá srovnáním zmíněných národních právních úprav. Na základě jejich srovnání bylo shledáno, že stabilnější právní úpravu nalezneme v Německu. Naopak příznivější z hlediska požadavků je česká právní úprava. |

| Abstract: | The presented work deals with the issue of the impact of newly emerging environmental standards on one group of addressees of the given legal standards, which are entrepreneurs in the construction industry. The thesis will address the implications of climate change for the construction sector, including the impact on the stability of the legal system and legal confidence and the impact on one group of addressees of the legal standards, namely construction entrepreneurs. As new regulations and standards are introduced to support the construction of more sustainable and environmentally friendly buildings, it is important that the legal framework supporting these changes is stable and consistent. This can provide businesses with the certainty and confidence they need to operate effectively and can help support the transition to more sustainable building practices. However, if the legal framework is unstable or inconsistent, this can create uncertainty and insecurity for businesses, which can make it difficult for them to operate successfully in the building construction sector. The aim of this thesis is to assess which of the analysed national arrangements is more favourable for entrepreneurs in the construction sector. It focuses first on the legislation at EU level and then on the level of two selected Member States, namely the Czech Republic and the Federal Republic of Germany. The thesis is divided into five main chapters, with the last chapter dealing with a comparison of these national laws. On the basis of their comparison, it was found that the more stable legislation can be found in Germany. On the other hand, the Czech legislation is more favourable in terms of requirements. |
